FISHING LICENSE REQUIREMENTS

REMINDER: Delawareans and non-residents alike now must be licensed to fish fresh and salt water. Crabbing and clamming also require licenses.
  1. Fishing License can only be issued to an individual presenting one of the following acceptable forms of I.D. a) current drivers license  b) current State I.D.  c) voter registration card  d) copy of most recent tax form.  To purchase a license for someone else, an original or copy of the above forms of I.D. is acceptable.
  2. Fishing license is valid January 1 through December 31
  3. Having a boat fishing license is an option that means anyone fishing on that boat will not need a separate fishing license. Thus a boat owner can hold a boat fishing license that takes the place of a fishing license for everyone aboard his vessel. A resident who buys a boat fishing license also will be given a regular fishing license to use anywhere in the state. Non-resident holders of boat fishing licenses will need to purchase a non-resident fishing license to fish elsewhere in Delaware when not aboard their vessels.
1. RESIDENT FISHING LICENSE
Any resident of Delaware who is 16 years of age or older, but less than 65 years of age, is required to have a license to fish in tidal and non-tidal water However, the following may fish without a fishing license:

EXEMPTIONS

  1. Any resident who owns or lives upon a farm in this State containing 20 or more acres and the members of his or her immediate family who reside on the farm may
    fish on said farm. (Freshwater fishing only)
  2. Any resident living in this State for at least one year immediately prior to the date of application who has been honorably discharged from the Armed Forces and
    certified by the Veterans' Administration as having at least a 60V service-oriented disability.
  3. Any member of the Armed Forces who is a patient in a military-hospital and submits a written statement signed by the patient's commanding officer certifying
    the nature of the disability and place of station.
  4. Any patient in a Veterans' Administration facility in this State or any person in a rehabilitation hospital under the Department of Health and Social Services, provided such persons carries identification which verifies his/her status.
  5. Any person who is legally blind.
2. NON-RESIDENT FISHING LICENSE
Any non-resident who is 16 years of age or older is required to have a license to fish in tidal and non-tidal waters. Non-residents who meet the criteria of (c), (d) and (e) in Section 1 are exempted. Non-residents may purchase a seven (7) consecutive day fishing license.
3. TROUT STAMPS
Residents 12 years old but less than 16 years old are required to purchase a juvenile trout stamp which costs $3.10(including agent's fee). Residents 16 years of age and older, but not over 65 years old, are required to purchase a resident trout stamp if fishing in a designated trout stream on or between the first Saturday in April and June 30 and on or between the-first Saturday in October and November 30 of the same year. A resident trout stamp costs $5.20(including agent's fee).

Non-residents, 12 years of age and older, are required to purchase a non- resident trout stamp if fishing in a designated trout stream on or between the first Saturday in April and June 30 and on or between the first Saturday in October and November 30. A non-resident trout stamp costs $7.20(including agent's fee).
4. DETERMINATION OF RESIDENCY
For purposes of determining the "residency" requirement for Hunting and Fishing Licenses, Subsection 101, Chapter 1, Title 7 of the Delaware Code defines a resident as "any person not an alien who has resided a year or more within this State." Chapter 5, Title 7 of the Delaware Code, states "Each applicant for a resident's license shall present reasonable proof to the Department or its duly authorized Agent, that he or she is a bona fide resident of this State."

An applicant's State Drivers License shall serve as proof of residency.

If you do not possess a drivers license, an applicant may produce a copy of a State of Delaware Income Tax Form for the preceding year or a Voter Registration Card. in some instances a person may claim to be a resident, but is unable to provide any of the above. LICENSE REQUIREMENTS FOR ARMED FORCES MEMBERS
STATIONED IN DELAWARE

Any member of the Armed Forces of the United States of America while actually stationed within this State, shall be deemed a resident of this State for the purpose of obtaining a license to hunt, trap and fish in this State. Each such application shall be supported by a written statement signed by the applicant's commanding officer certifying to the applicant's place of station within this State.

5. DUPLICATE FISHING & HUNTING LICENSES
Replacements for lost licenses are only issued from the Division of Fish and Wildlife's Dover Office at 89 Kings Highway, Dover, Delaware 19903. The following information is required: the type of license lost, the name it was issued to, where and when it was purchased. There is a fee of $.25 for replacing a lost license. The Division will forward a duplicate license by return mail.
Exceptions:
There will be no duplicate Trout Stamps or Waterfowl Stamps issued.

Surf fishing vehicle permits allow 4-wheel drive vehicles access to designated beach areas for the purposes of fishing. Surf fishing vehicle permits are issued for the calendar year.  Permit Regulations are strictly enforced.  Violations may result in a fine of $25 to $250 for a first offense and $50 to $500 for a second offense.

1. PERMIT REGULATIONS
  1. WHO QUALIFIES?
    Any 4-wheel drive vehicle which has been licensed and registered to operate on public highways with a minimum ground clearance of not less than 7 inches.
  2. Person applying should present a current vehicle registration, or be able to provide all the necessary information required on the application. The applicants State Driver's License is a required I.D.  Surf Fishing Vehicle Permits may be purchased by an individual other then the registered owner - please call for info.
  3. The permit is only valid for the vehicle to which it has been issued and must be properly affixed on that vehicle. For additional fee, a permit may be transferred to another vehicle, provided the owner has the yellow copy of the previous permit form.  Transfers can only be done by the State Office.
  4. Permit holder must be actively engaged in surf fishing when the vehicle is out on the beach. Appropriate fishing gear must be present.
  5. Vehicles are to be kept off of dunes. Cross only at designated vehicular crossings.
  6. This permit also entitles the holder to enter all state parks that charge an entrance fee.
  7. For the safety of the fisherman, vehicles must carry a tire pressure gauge, tow rope or chain, shovel, and a jack with a board to place it on.
